    2Shipping times and product availability

    Our shipping times vary between 48 hours to 8 days, according to the product(s) ordered and are noted in our catalogue and product sheets. Shipping delays depend on the availability of products ordered (expressed in business days, excluding weekends and holidays), where days are counted as of the date your order is confirmed.
    Warning: When paying by check, orders are considered confirmed only when the check for that order is received. If you are not available to receive the shipment, an attempted delivery notice will be left at the destination address. All proposed products are available, within the limit of available stock.

    5Acceptance of Terms

    The customer acknowledges, at the time that their order is placed, that they have read and understood the particular Terms of Sale posted on this screen and declares expressly to have accepted them without reservation. The present General Terms of Sale govern the contractual relations between Electrofitness.com and the customer, both parties accepting them without reserve. These General Terms of Sale will prevail over any other condition on any other document, unless agreed beforehand, in writing.

    The photographs, illustrations, animations and video clips illustrating products are non-contractual. If, despite our efforts, errors are made in the depiction of products, Electrofitness.com cannot be held responsible.

    All of the products distributed by Electrofitness.com comply with the standards in effect in France and are described as accurately as possible along with a presentation of their essential characteristics on the website www.electrofitness.com.

    7Order

    Placing an order
    Orders may be placed:

    Your order is considered to be accepted when it is placed, and confirmed when your payment is received.
    Automatic registration systems shall be deemed valid proof of the nature, content and date of the order. ELECTROFITNESS.com confirms order acceptance via an email sent to the address provided by the customer.
    The sale will only be concluded upon receipt of the order confirmation and full payment. ELECTROFITNESS.com reserves the right to cancel any order from a customer with whom there is a dispute over a payment for a previous order.
    The details provided by the purchaser when the order is placed are binding upon the purchaser: in the event of an error in the addressee’s coordinates the vendor shall not be held responsible in the event it is impossible to deliver the product.
    After confirming your order you will receive an email acknowledging that we have received your offer, and a confirmation of the products ordered, and shipping costs and time.
    Your order will be processed as quickly as possible, and at the latest, within 30 business days. This period shall begin on the day after you place your order.
    In the event that an ordered product is unavailable, you will be informed as soon as possible. In this case, we will reimburse the corresponding amount immediately, and at the latest, within 30 days of your request. The reimbursement will be processed by credit to your bank account or by check.
    In certain cases, such as payment failure or incorrect address, or other issue arising from customer error, we reserve the right to block your order until the problem has been resolved.

    All orders imply acceptance of the present General Terms of Sale, and of the prices and descriptions of products offered for sale.
    The sales contract shall not be definitively concluded until we receive payment or the method of payment for checks.

    8Shipping

    Our shipping times are posted in our catalogue and on our product sheets. Shipping times depend on the availability of products ordered (expressed in business days, excluding weekends and holidays), where days are counted as of the date your order is confirmed and the receipt of your payment.
    Your order is packaged and shipped within 24 hours of receipt of your payment (subject to product inventory).

    Warning: When paying by check or wire transfer, orders are considered confirmed upon receipt of the payment for the corresponding order.
    In the event that a product, accessory or supply item is unavailable, we will notify you of potential shipment delays through notices on our website or by contacting you as quickly as possible.

    If you are not available to receive the shipment, an attempted delivery notice will be left at the destination address and you will have 10 days to claim your package from the Post Office.

    Please note:
    For orders outside of metropolitan France, the customer agrees to pay all taxes due on imported products, customs duties, value added tax and any other tax due in application of the laws of the destination country. All orders placed with ElectroFitness.com are destined for the personal use of the customer, and customers or recipients of products are prohibited from reselling any or all of the products. ELECTROFITNESS assumes no legal liability for a customer’s failure to pay required taxes.

    Due to product availability, items from a single order may be shipped in multiple shipments. The customer is only responsible for the cost of a single shipment. If the customer wishes to ship items to 2 different addresses, the customer must place 2 orders, each with its own associated shipping fees.
    The condition of ordered products and accessories must be verified upon delivery. Any reservation or objections pertaining to delivered products must be noted on the delivery slip.
    If a product does not conform with your order, you must let us know by contacting us at +44 20 3318 9856 or by sending an email to info@electrofitness.com within no more than 48 hours of receiving your order.
    The following shall be considered force majeure events due to circumstances outside the vendor’s control, releasing the vendor from the obligation to deliver: war, riot, fire, strike, accidents, inability to obtain supply.
    All merchandise is shipped at the recipient’s risk. Always inspect your package upon delivery. You have 48 hours to file complaints against the carrier in the event that items are damaged or missing.

    9Revocation (applicable only to individuals)

    To exercise your right to revocation, in accordance with the laws currently in effect, you have 14 business days from receipt of your order to return the products or request an exchange.
    To exercise this right, contact our After Sales Service at +44 20 3318 9856 (then press 2) who will send you a return slip via email.

    We cannot accept returns of used products.
    Products must be returned in their complete, original condition (packaging, accessories, notices, etc.) accompanied by a copy of your invoice and the return slip. Products sold in blister packaging or sealed with a warranty label must be returned in their original condition. No exceptions will be made.

    If the returned products are damaged or incomplete, we reserve the right to decrease the refund price by 10% or refuse an exchange or refund.

    Revocation after shipment:
    If you elect to exercise your right to revocation, ELECTROFITNESS will reimburse the total amount of your order, less any restocking fees up to 10% of the product value based on the sale price when the item is returned.

    Important:
    Shipping costs for returned items will not be refunded.

    All items can be subject to revocation, by exchange or reimbursement, except those with a notice to the contrary. For example, items intended for personal use, such as electro stimulation shorts or belts worn in direct contact with the skin which can not be reconditioned for resale under any circumstances.

    If you request reimbursement, you are obligated to return the product(s) in question. You must return the product(s) within one week after notifying the vendor of your request for reimbursement.

    You will be reimbursed the amount you paid (the price of the product you purchased and any applicable outbound shipping costs). Reimbursements will be credited to your bank account or paid by check as quickly as possible and no later than 30 days after the date on which the customer exercised revocation right.

    10Price

    Product price:
    The price of an item, as it appears in the corresponding product sheet, is expressed in Euros inclusive of taxes for delivery to metropolitan France and EU Member countries. Outside of this area, the price shall be expressed exclusive of taxes on your purchase order and customs duties may be collected upon delivery. (Please consult your Customs Office for more information.)
    The price listed on the product sheet does not include shipping fees and is only valid for the period indicated on the website subject to product inventory.

    Shipping rates:
    Economy-rate Colissimo service 2-day shipping to metropolitan France costs € 6.80 and is free on orders of € 60 or more, inclusive of taxes (except where otherwise indicated on the website).
    Express Chronopost 24-hour shipping to metropolitan France costs € 15.
    For all other destinations, package weight and the destination address will be used to calculate shipping fees and delivery times. Please contact us with any questions about shipping rates. International shipping rates

    The total price indicated in your order confirmation is the final price, expressed inclusive of taxes, including VAT for metropolitan France and EU Member countries. It is expressed exclusive of taxes outside of this area and your order may incur customs taxes in the destination country.
    This price includes the product price, handling, packaging and shipping fees.

    Please note: Any adjustment to the applicable tax rate may be recovered against product prices. However, the price cannot be changed once your order has been confirmed.

    In addition, if one or more taxes are created or adjusted, upwardly or downwardly, this adjustment may be reflected in the sales price of items listed on the website www.electrofitness.com.

    11Payment

    The invoice amount is the amount indicated on the order confirmation your received via email.

    Payment can be made by:

      The CAISSE D’EPARGNE SP+ solution allows you to submit payment via a 100% secure CAISSE D’EPARGNE bank server. Your banking information is encrypted and transmitted to the bank’s validation servers in SSL (Secure Socket Layer) mode.
      A customer-approved order shall not be considered final until the appropriate banking payment centres have approved the transaction. In the event that payment is refused, the order will automatically be cancelled and you will be notified via email.

    12Retention of ownership

    The IMPULSEO company retains ownership of the goods supplied until their full payment, in accordance with the French law 80 336 of May 1st 1980, on the retention of ownership.

    Payment means the payment of the price of the products, and any costs associated with the sale or interest.

    In the event of non-payment, you must at your own risk and expense, return the unpaid products, upon receiving a request by registered letter with acknowledgement of receipt.

    In this case, the sale will be rightfully solved on the day of the request for return.

    13Disputes

    This contract is subject to French law. ElectroFitness.com cannot be held responsible for damages of any kind, whether tangible, or intangible, that could result from a malfunction or improper use of products sold. The same reserve applies to any change of product specifications by the manufacturers. The responsibility of ElectroFitness.com would, in any case, be limited to the amount of the order and cannot be blamed for simple errors or omissions that may occur despite all precautions taken in presenting the products. In the event of difficulties in the implementation of this contract, the buyer has the possibility, before taking any legal action to seek an amicable solution, especially with the help of a professional association of the sector, a consumer association, or any other counsel of his choice. You are reminded that the search for an amicable solution does not interrupt the “short time” of the legal warranty, nor the duration of the contractual warranty. You are reminded that, as a general rule and subject to the discretion of the courts, the provisions of this agreement relating to the contractual warranty assumes that the buyer will honour all financial commitments to the seller.
    Claims and disputes will always be received with respectful consideration, and with the assumption of good faith from the one who takes the trouble to expose its situations. In case of dispute, the customer will first contact the company in order to seek an amicable solution. Otherwise, the Tribunal de Commerce de Béziers has exclusive jurisdiction, regardless of the place of delivery and payment method accepted.

    14Warranty

    The warranty for all our products is the manufacturer's warranty:

    COMPEX
    COMPEX devices are warranted against all manufacturing defects for a period of 2 years from the date of billing. The warranty covers all problems resulting from material quality or defective manufacturing. On most Compex products, the manufacturer offers a free one-year warranty extension for your Compex device. You only need to register your product on the www.compex.info web site by indicating the serial number of your Compex device (before the end of the original warranty period).
    This warranty applies to the electro stimulator (parts and labour), but does not cover the battery, charger, cables, or electrodes. Cables, chargers and batteries are guaranteed for 6 months.

    CEFAR
    CEFAR devices are warranted against all manufacturing defects for a period of 2 years from the date of billing. The warranty covers all problems resulting from material quality or defective manufacturing.
    This warranty applies to the electro stimulator (parts and labour), but does not cover the battery, charger, cables, electrodes, or any other consumables supplied with the device. Cables, chargers and batteries are guaranteed for 6 months.
    If your Compex or Cefar device is faulty, or has been delivered with a defect, or has been damaged, or if a defect appears during the warranty period, please contact directly the manufacturer customer service at +33 (0)5 59 52 80 90.
    If you have a problem or questions about how to use your Compex or Cefar device, please contact the Electrofitness.com customer service at +44 20 3318 9856. A customer support representative will help you.

    SLENDERTONE
    SLENDERTONE devices are warranted against all manufacturing defects for a period of 2 years from the date of billing. The warranty covers all problems resulting from material quality or defective manufacturing. This warranty applies to the electro stimulator (parts and labour), but does not cover the battery, charger, cables, or electrodes.
    If you think that your product has been delivered with a defect, or has been damaged, or if a defect appears during the warranty period, please follow this procedure:
    Send an email to info@slendertone.com or call the Slendertone customer service at +353 94 902 9936.

    • The Slendertone Consumer Service will verify directly with you if your product is defective or if it is simply a problem of use. If the Consumer Service representative considers that the product is defective, you will be asked to return it to Slendertone.
    • The Customer Service will then assign you a Return Merchandise Authorisation number that is required for returning any defective product. Please verify that the product is clearly labelled with its RMA number and be sure to indicate this number in all correspondence related to this subject.
    • Once the defective product has been received, Slendertone will send you a replacement unit or, if this article is no longer available, a product of equivalent value.

    All items returned to Slendertone, either defective, damaged or unwanted, will only be accepted under the following conditions:

    • All items must be clearly labelled with the RMA number.
    • All items remain under the responsibility of the customer until they are delivered to Slendertone.
    • If Slendertone items are defective, we will ask you to return to us only the controller. For the Fortex device, we will ask you to return only the lid of the battery compartment and the manual.
    • We do not refund any postage or packaging costs since, when ordering, we offer free delivery for all electro stimulation devices.

    GLOBUS / PERFEX
    These devices are warranted against all manufacturing defects for a period of 2 years from the date of billing. The warranty covers all problems resulting from material quality or defective manufacturing. This warranty applies to the electro stimulator (parts and labour), but does not cover the battery, charger, cables, or electrodes.
    If a product does not work, you need to contact the Electrofitness.com After Sales Service at +44 20 3318 9856, or by email at sav@electrofitness.com, who will send you a return form to attach to your package when returning your device.
    Any request that does not include this return form will be automatically be blocked until our services receive the form.
    If the problem detected by our technicians is within the scope of your product warranty, it will be repaired or replaced with a new device if the problem cannot be repaired, within 10 to 30 days (depending on the availability of the parts to replace) from its receipt at our premises.
    If the failure is not covered by the warranty, we will send you a free quote within 5 days, specifying the needed repairs. You can then accept or decline our quote.

    Please note:
    If the detected failure is covered by the manufacturer's warranty, we will refund your shipping costs to return us your device by sending you a set of electrodes or a bottle of conductive gel. If the repair is out of warranty, these fees are your responsibility.
    Furthermore, we are committed to returning your device, repaired or not, at our own expense.
    Excluded from any warranty:
    a. Defects resulting from improper use or lack of maintenance.
    b. Damage due to incorrect handling, misuse or abnormal use, for business or commercial purposes.
    c. Accessories and spare parts that are subject to normal wear or regular maintenance (disposable or rechargeable batteries, cables, electrodes, etc.).
    d. Costs of shipping and modification to the device, in the event of a recall by the manufacturer for failing series.
    e. Damage caused by an external event (lightning, water damage, etc.).
    f. Intervention on the device by another person not authorized by the After Sales Service.

    NOTE: Our commitment ends in case of failure of the manufacturer to provide required spare parts and accessories.

    ELECTROFITNESS guarantees that all selected products are manufactured or produced or edited in FRANCE or in the EEC countries.

    The “Cable and Battery Peace of Mind Warranty” from Electrofitness.com
    This optional warranty is an additional service offered by Electrofitness.com when buying your electro stimulation device. It lets you ensure your cables, chargers and batteries for a period of 1 year from the date of billing of your device. It is offered at a price of € 4.90.
    This warranty must be selected with your original order and cannot be the purchased as a separate sale.
    Any replacement of a defective accessory is conditioned upon the return the defective accessory.

    DISPUTE
    This contract is subject to French law. ELECTROFITNESS.com cannot be held responsible for damages of any kind, whether tangible, or intangible, that could result from a malfunction or improper use of products sold.     IN CASE OF DISPUTE, THE CUSTOMER WILL FIRST CONTACT THE COMPANY IN ORDER TO SEEK AN AMICABLE SOLUTION. OTHERWISE, THE TRIBUNAL DE COMMERCE DE BÉZIERS HAS EXCLUSIVE JURISDICTION, REGARDLESS OF THE PLACE OF DELIVERY AND PAYMENT METHOD ACCEPTED.

    15Responsibility

    The IMPULSEO company has an obligation to achieve results during all stages of the ordering process, as well as stages following the conclusion of the contract.
    Thus IMPULSEO is committed to describing with great accuracy the products sold on the Impulseo web site Electrofitness.com. On the other hand, Impulseo could not be held liable in the event that the breach of its obligations is attributable either to an unforeseeable and insurmountable fact from a third party to the contract, or a case of force majeure as defined by the French Law. Similarly, Impulseo cannot be held liable for any inconvenience or damage arising from the use of the Internet, including a break of service, an external intrusion or the presence of computer viruses.
